When is the Best Time to Contact a Lawyer?

The marriage is over. You know it. You haven’t talked separation yet, or mentioned the D word, but it’s there, waiting…

It’s too soon to consult a lawyer, isn’t it? Not yet, not at this stage. It doesn’t seem right to call before you and your spouse have even had the conversation. That would be mean, wouldn’t it?

It’s not too early to call a lawyer. If you’re even thinking of ending the relationship, pick up the phone.

No, it wouldn’t be mean. It would be smart. You need to know your rights, know what your options are, and what you’re entitled to. 

Yes, but you’re not looking to ambush your spouse, to attack him or her with legal proceedings and paperwork. You can separate for a few months, give yourselves time to wade through the emotional quagmire, and deal with the paperwork later. That would be better, wouldn’t it?

Remember, meeting with a lawyer does not mean attacking your spouse. A good lawyer will try to help you address and resolve issues as cooperatively as possible, and will only recommend starting a court action if absolutely necessary. Do your research. Find a lawyer who strives to keep things out of court and focuses on what is best for the children; not a lawyer who boasts about being a bulldog. 

Plus, issues such as spousal support, property division, and parenting time can be adversely affected by a protracted timeline. Waiting too long to consult a lawyer can cost you more in both time and money, and more importantly, you could hurt claims you might have had if you had done something earlier.
